Information about warcrimes
WarCrimes.gov.ua (https://warcrimes.gov.ua/) — a national platform developed within the framework of cooperation between the Office of the Prosecutor General of Ukraine and the intellectual public initiative "IT Defenders" in order to document war crimes and crimes against humanity committed by the Russian Federation in Ukraine.
WarCrimes.gov.ua ("WarCrimes" or "we") protects and respects your privacy. Please read this Privacy Policy carefully to understand how we will process your personal information, as well as other types of information. This Policy also applies to your use of the WarCrimes Application ("Annex 1").
WarCrimes is responsible for processing your personal information when using the Application and is a "data controller" in accordance with applicable data protection laws.
"All collected data will be transferred free of charge to the Office of the Prosecutor General for criminal prosecution of those involved in the commission of war crimes.
WarCrimes reserves the right to change the policy at any time by making the updated version of the Software Product available for download and providing a link to the new Policy. You are not required to download any updated App, but in some cases you will not be able to continue using the App until you download the updated version.

What personal information do we collect
Personal information is any information about you that can be directly or indirectly identified. Therefore, personal information does not include information from which your identity data was deleted, i.e. anonymous information.
We may collect, share and use personal information about you, as well as other types of information in connection with your use of the Software Product. A full description of the types of information that WarCrimes collects can be found in Annex 1.
How we use your personal information
We may use your personal information and other information that you provide to us through the software product in the following ways:

Exchange of information
We may share your personal information with such third parties:
- IT service providers: if necessary, involve external IT service providers to host and administer the Software Product. Your information will be shared with external IT service providers, who will only process the information as needed to perform technical services.
- International organizations and law enforcement agencies: we share the information you provide with SP with international organizations and law enforcement agencies, including law enforcement, criminal and other investigative bodies, to help initiate legal proceedings against individuals who commit war crimes. We share information with these bodies if necessary to ensure our and other legitimate interests in bringing to justice those responsible for war crimes, as well as to meet the public need for justice. If you choose to provide your name, nickname, or email address, we may share this information with these organizations so that they can independently verify your data with you.
- Legal professionals and defendants: in the event that your footage leads to a lawsuit, we may have a legal obligation to disclose your personal information to legal professionals such as prosecutors and lawyers, courts and tribunals, as well as defendants in such proceedings. Such disclosure may include all content that you make available, as well as other information that you have provided to us, such as your name or nickname and location. Legal disclosure may only include identifying information that you have provided to us and that we have collected with your knowledge. Depending on the circumstances, such an exchange takes place in order for us to comply with our legal obligations, or, if necessary, to meet our and other legitimate needs to bring those responsible for atrocities to justice, as well as public needs to restore justice.
Storage and security
After receiving your information, we use strict security policies and procedures to control access to information and reduce the risk of loss, misuse, or unauthorized access to this information.
The Software Product uses security policies to ensure its privacy and security. You will receive instructions on these features using the instructions available after downloading the App. It is important that you fully understand and use these features to prevent unauthorized access to your account, as well as to protect the content you create and, importantly, your personal safety and security as a user. You should try to restrict access to your device and browser whenever possible, and close the App when not in use.
Transfer of personal information outside of Ukraine or to international organizations
Some of the third parties listed in Section 5 may be located in jurisdictions outside of Ukraine, and we may share your personal information with them. In such cases, these jurisdictions or recipients may protect your personal information in accordance with applicable law.
We will perform such data transfer based on the fact that:
- The European Commission has adopted an "adequacy decision" in relation to the jurisdiction where the recipient is located;
- we have introduced "appropriate guarantees", for example, the European Commission has approved standard contractual provisions with the recipient or the EU-USA. Privacy Shield Framework; or
- in the absence of an adequacy decision and if it is not possible to introduce appropriate safeguards, that the transfer is necessary for reasons of an important public interest in the fight against war crimes or is otherwise necessary for the establishment, implementation or defence of legal claims.
Your rights
Users of the Software Product have certain rights regarding the personal information that we store about them. Depending on the circumstances, they may include the right to:
- request access to your personal information and get a copy of the information we store about you;
- correct your personal information that we store if it is incomplete or inaccurate;
- delete your personal information if there is no good reason to continue using or storing it;
- require that your personal information be used for limited purposes only;
- object to the processing of your personal information if the basis for processing your personal information is our legitimate needs or the legitimate needs of a third party, or public needs;
- require the transfer of certain personal information to you or a third party;
- withdraw your consent to the processing of your personal information at any time, if we rely on it as the legal basis for doing so; and
- file a complaint with the appropriate data protection authority in your jurisdiction.
Child safety
Using online services, it is very important to protect the safety of children. We do not knowingly collect information from children.
Data storage
We only store your personal information for as long as necessary for the purposes for which we collected it. When evaluating the storage period of your personal data, we take into account:
- our industry requirements and services provided;
- any statutory or legal obligations;
- purposes for which we collected personal data;
- legal grounds on which we based our processing;
- types of personal data that we have collected;
- the quantity and categories of your personal data; and
- whether it is possible to reasonably achieve the goal of processing by other means.

Annex 1
We may collect, store, and use the following categories of personal information about you:
Information you provide
We may process the following information provided by you:
- when registering and using the Software Product, including information that you provide by filling out forms in the SP, such as your name or nickname and email address (if submitted);
- when protecting or uploading content via SP, including any notes attached to images that you upload via the App or web interface; and
- when providing us with feedback or a request for additional services.
Please note that you are not required to provide an email address. If you want to directly link your identity to the content you send us, this will be very useful for any investigations that use your data. Please refer to Section 5 above to find out when personal information may be shared with third parties.
You will not be able to access metadata about the content you capture through the App through the App itself; we knowingly delete this metadata to ensure that it cannot be inadvertently shared by you with anyone other than eyewitnesses, thereby posing a risk to their security. You'll be able to view images taken in the App's gallery to add notes, but you 't be able to change the content itself after it's uploaded via the App or web interface.
When adding notes to any images you send, you should read the security instructions to make sure that your use of this tool does not violate the rights, interests, or safety of others that may appear in the materials.
Information from other sources
We may combine the information you provide with information from other sources, such as publicly available information obtained from the Internet and from human rights reports, to confirm it. However, we will not attempt to combine the information in such a way that users can be identified where they choose to remain anonymous.
Device information
We may collect and process information about the mobile phone or other device that you use to register or access the App, including the device brand, model, name, and product type.
Location and other confirmation information
When you use the App, we collect, process, and use information about the location of your mobile device. This information is embedded and encrypted as part of the metadata in the image or video you are shooting. This data is obtained from:
- geolocation coordinates;
- identifiers of nearby mobile communication towers;
- Wi-Fi networks or Wi-Fi access points within range (where Wi-Fi is enabled);
- any Bluetooth addresses that are in the range (where Bluetooth is enabled); and
- the data received from the sensors in your device is related to your movement.
This information is not combined with device IDs such as IMSI, and the user's IP-address is not collected.
We only collect location information and other verification information from the moment you activate the camera on your device; collection is disabled after use. You can disable this feature at any time by disabling the location services settings for the App on your mobile device.
Aggregated data
To better understand and serve Software Product users, we collect summary statistics on service usage. This information does not identify users, and we may share these statistics by describing the App and service to other third parties.
Tracking technologies
To ensure confidential and secure operation, the software does not use cookies, web beacons, analytics tools, or unique device IDs or built-in applications.
